General Disclaimer
By booking, purchasing, using, or participating in any photography, videography, drone, aerial imaging, or related services provided by SW Photography (“the Company”), you (“the Client”) acknowledge and agree to the following terms and conditions.
The Company will carry out all services with reasonable care, skill, and professionalism. However, the Client understands and accepts that participation in photography sessions, videography sessions, drone operations, on-location shoots, and related activities may involve certain risks, including but not limited to property damage, personal injury, equipment malfunction, weather-related issues, third-party actions, and unforeseen circumstances.
Assumption of Risk
The Client voluntarily assumes all risks associated with the services provided by the Company, including risks arising from:
Drone operations and aerial filming;
Photography or videography conducted on private or public property;
Environmental conditions, terrain, weather, wildlife, or surroundings;
The actions or negligence of participants, guests, venue staff, or third parties;
Technical failures, equipment malfunctions, or loss of footage or images.
Limitation of Liability
To the fullest extent permitted by applicable law, the Company, its owners, employees, contractors, affiliates, and representatives shall not be held liable for:
Any direct, indirect, incidental, consequential, or special damages;
Personal injury, death, emotional distress, or property damage;
Loss of income, business interruption, or reputational harm;
Loss, corruption, delay, or failure of photographic, video, or drone footage;
Damages resulting from weather, venue restrictions, acts of God, government restrictions, technical failures, or circumstances beyond the Company’s control.
The Client agrees that any participation in or use of the Company’s services is done entirely at their own risk.
Waiver of Claims
The Client hereby waives, releases, and forever discharges the Company from any and all claims, demands, causes of action, liabilities, damages, costs, or expenses arising out of or related to the services provided, including claims based on negligence.
The Client agrees not to commence or participate in any legal action, lawsuit, claim, or proceeding against the Company relating to any injury, damage, loss, or incident arising from the services provided.
Indemnification
The Client agrees to indemnify and hold harmless the Company from and against any claims, liabilities, damages, legal fees, or expenses arising from:
The Client’s own actions or negligence;
The actions of guests, participants, or third parties associated with the Client;
Any breach of this agreement by the Client;
Any claims brought by third parties relating to the services provided.
Drone Services
All drone services are conducted in accordance with applicable aviation laws and regulations. The Company reserves the right to cancel, postpone, or modify drone operations where necessary for safety, legal compliance, weather conditions, restricted airspace, or operational concerns.
The Client acknowledges that drone operations may be subject to limitations outside of the Company’s control.
No Guarantee
While every effort will be made to deliver high-quality services and results, the Company does not guarantee specific outcomes, artistic preferences, weather conditions, exact shot requests, or uninterrupted operation.
Governing Law
This disclaimer and waiver shall be governed by and interpreted in accordance with the laws of England and Wales.
Acceptance
By using this website, booking services, making payment, or participating in any session or project with the Company, the Client confirms that they have read, understood, and agreed to this Disclaimer & Liability Waiver in full.
